In-House Rentals: Equipment and services directly owned and managed by us, available for rent through our platform.
Third-Party Rentals: Equipment and services offered by third-party suppliers ("Suppliers"), for which we act as an intermediary by listing their products on our platform.
2. Acceptance of Terms
By using our website and services, you accept and agree to be bound by these Terms, as well as any other policies or guidelines that are posted on our website. We reserve the right to modify or update these Terms at any time, and your continued use of our services after any such changes will constitute your acceptance of the updated Terms.
3. Account Creation
To access certain features of our website, such as booking equipment or services, you may be required to create an account. You agree to provide accurate, current, and complete information during the account registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Booking and Rental Services
We provide two types of rental services:
In-House Rentals: Equipment directly managed and rented by us. By booking our in-house rentals, you agree to the specific terms and conditions provided for those rentals.
Third-Party Rentals: Equipment rented from third-party Suppliers through our platform. You agree to comply with the terms and conditions of the relevant third-party Supplier when booking such equipment.
For both in-house and third-party rentals, you must complete the booking process and provide any necessary payment information before the reservation is confirmed.
5. Pricing and Payment
All rental prices for both in-house and third-party equipment are listed on our website. Prices are subject to change without notice. Payments for bookings are processed via our website for in-house rentals and through the third-party Supplier’s payment system for third-party rentals.
In-House Rentals: Payments are made directly to Phaloanaire Rentals.
Third-Party Rentals: Payments for third-party rentals are handled by the third-party Supplier, and you agree to their terms of payment.
You agree to pay the full rental price, including taxes, fees, and any other applicable charges at the time of booking.
6. Cancellations and Modifications
In-House Rentals: Our cancellation and modification policies apply to bookings made for our in-house rentals. These terms will be provided during the booking process, and you agree to abide by them.
Third-Party Rentals: Cancellations and modifications of third-party rental bookings are subject to the terms and conditions set by the Supplier. We recommend reviewing the Supplier’s policies before completing a booking.
7. Equipment Use and Care
You are responsible for the use and care of any rented equipment during the rental period. You agree to:
Use the equipment for its intended purpose.
Follow all instructions provided for the use, handling, and maintenance of the equipment.
Ensure that the equipment is returned in the same condition as it was received, subject to normal wear and tear.
For third-party rentals, you agree to abide by the Supplier's instructions for use and care of the equipment.
8. Damage, Loss, or Theft
You are liable for any damage to, loss, or theft of the rented equipment during the rental period. You agree to pay for the repair or replacement cost of any damaged or lost equipment. For third-party rentals, any claims for damage, loss, or theft must be directed to the relevant Supplier, and you agree to indemnify us for any claims arising from the rental transaction.
9. Insurance
We recommend that you secure insurance for the rented equipment, whether through us or a third-party Supplier. We do not provide insurance for the equipment and are not responsible for any damage or loss that may occur during the rental period.
10. Limitation of Liability
To the fullest extent permitted by law, Phaloanaire Rentals shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or the rented equipment. Our total liability, for any claim arising out of or relating to these Terms, shall not exceed the amount you paid for the rental of the equipment.
11. Intellectual Property
